‘Client’ - A person or persons, business, company or organisation whom use any of Pure World Designs services.

‘Project’ - Any work carried out or service provided by Pure World Designs for the Client.

'Go Live' is when Pure World Designs sign off the website and it is then ready to be placed on the World Wide Web.

'Domain' means the website address of the Clients website, as specified by the Client or bought by Pure World Designs on behalf of the Client.

‘Hosting’ is the yearly cost to keep a Client’s website live and online.

'Content' describes the text and images that we place on the website at the request of the Client.

These conditions will apply for any contract between Pure World Designs and the Client, to the exclusion of all other terms and conditions.

CONTACT

Pure World Designs will expect any Client to research before making contact.  This will mean checking to ensure that the business or website idea is totally legal before proceeding.

Email, telephone and letter will be the communication methods Pure World Designs use.  It is always the Client's responsibility to inform Pure World Designs of any change in E-mail address, so we always have up to date E-mail contact details. Pure World Designs cannot be held liable in any way if they have not been given the correct details.

Pure World Designs will supply the Client with an expected completion date for the Project.  Pure World Designs will work to meet any deadline, but cannot guarantee to complete the Project by this date.

The Client must remain in contact with Pure World Designs throughout the Project. Pure World Designs will expect the Client to keep in contact on a weekly basis, if for some reason there is not contact for more than 1 week Pure World Designs will contact the Client by email and by phone. If Pure World Designs do not receive a response the Project may be liable for termination, and the deposit will not be refunded.

PAYMENT

Pure World Designs requires a 50% deposit before commencement of the work.  Pure World Designs will then require 25% payment on the Clients approval of the overall design. The final payment of 25% is to be made on completion of the website, once this payment has been received the website will then ‘Go Live’.

Any deposit paid to Pure World Designs is necessary to cover the cost of all design work carried out on the Clients behalf.  The Deposit is non refundable once Pure World Designs have sent the first design to the Client.

CONTENT

Pure World Designs takes no responsibility for any of the content on a Clients website and are not responsible for proofreading the content. Pure World Designs do not endorse and have not verified any of the material including any images or text content on Client’s websites.  Any material, data, information, images, video etc supplied to Pure World Designs, the Client hereby warrants that these do not in any way infringe the rights of any third parties and indemnify Pure World Designs against any action taken by any such third party. Pure World Designs is also not liable for any of the content or performance of these sites or for the Client's transactions with them.

The Client is solely responsible for any information or files relating to its website.

All images displayed on the Client's website will only be used after authorisation by the Client, and are the sole responsibility of the Client regarding usage and copyright. Should any legal issues or claims arise from the content or copyright of any images supplied by the Client to Pure World Designs, they will be the sole responsibility of the Client.

DOMAINS

If the Client requires Domain names Pure World Designs will register them. Although the domain names are registered to Pure World Designs, the Client is the legal owner of the domain.  If the Client requests to have details changed or the domain transferred, Pure World Designs will do this on behalf of the Client.

When Domain names are due for renewal, it is the sole responsibility of the Client to renew them. If for any reason a domain name expires, Pure World Designs can not be held liable for this.  Pure World Designs will contact the Client before the Domains are due for renewal to let them know they are nearing renewal.  If a Client buys a Domain name though another company, the Client then has sole responsibility for making sure the renewal takes place.

HOSTING

Pure World Designs will host the website for the Client if they request this service, the first years hosting is free, but any additional years hosting after the first year will be charged at the rates listed on Pure World Designs website.  Pure World Designs offer a fast, reliable and secure hosting service, but cannot guarantee that the website Hosting will be available at all times, especially in the event of server failure which is beyond Pure World Designs control.

If a Client renews there Hosting with Pure World Designs, included in this will be domain renewal if this was purchased at the start as part of one of the 3 Hosting packages.  Any Hosting renewal is due on a yearly basis from the date at which the Clients website went live.

Any Hosting renewal fees must be paid within 10 days of the Hosting expiry date. Pure World Designs reserve the right to take any website off of the internet where Hosting has expired and the Client has not paid the renewal fee.

Any Client wishing to move their Hosting elsewhere or transfer one or more Domain names away from Pure World Designs will incur an administration charge of £45.00 and this must be paid in full before any hosting or domain transfer can be arranged.

MAINTENANCE

Pure World Designs allow for minor web changes/maintenance to pages over a 1 month period from the date the website goes live.  This will include minor changes to text in sentences and paragraphs, this does not include updating whole pages of new text, any kind of page reconstruction, structure or navigation changes or any repairs Clients attempt to carry out on the website.

PRIVACY

Pure World Designs will never distribute your details to any third parties.  Therefore please do not allow any other person or persons to know your website or e-mail passwords.  Pure World Designs will not be responsible for these actions by a Client.  Please refrain from any sort of un-solicited bulk e-mailing or spamming.

LEGAL

On occasion Pure World Designs will purchase and use images on a Clients website.  These images are not to be used in any other way; they are solely for the website.  Pure World Designs are not liable for misuse of these images by the Client or any other person’s copying, altering or distributing the images to individuals or other organisations.

Pure World Designs cannot be held responsible for anything adversely affecting the Client's business operation, sales, or profitability that might be claimed is a result of a service offered by Pure World Designs.

Pure World Designs provide search engine optimisation for Clients; Pure World Designs do not guarantee any specific placement or high ranking on search engines.

Pure World Designs own all design, development and code of the website until they receive final payment in full. Once this has happened, the Client will then own the design and code of the website.

Pure World Designs are in no way liable for any damage, loss or corruption of files or information stored on the hosting servers or individual PCs relating to a Client's website.
